    On Friday, April 30, 2010 Kilgore Flares Company learned of formal federal charges filed that day in Buffalo, New York against several individuals and companies involving magnesium powder. Magnesium powder is one constituent in the composition of infra-red countermeasure flares that Kilgore makes for Department of Defense (DoD) customers. All flares that Kilgore fabricates for delivery to DoD customers undergo rigorous lot acceptance tests prescribed by DoD and must pass those tests before they are accepted. Kilgore takes very seriously its role as a responsible contractor to the U.S. Government and the delivery of fully compliant products to all of its customers.

    Kilgore has cooperated fully with U.S. Government officials throughout their lengthy investigation and will continue to do so. In August 2006, after becoming aware of certain facts, Kilgore ceased using magnesium powder from ESM Group for Kilgore flares delivered to DoD customers.
